| Library Board Policy 601 - Confidentiality Of Library Records | |
RESOLVED, The Reuben McMillan Free Library Association shall comply with the provisions of Ohio Revised Code Section 149.432 entitled “Confidentiality of Library Records” as that statute is amended from time to time. Ohio Revised Code Section 149.432 generally provides that the Library shall not release any record containing information: 1) that the Library requires an individual to provide in order to be eligible to use Library services or borrow materials; 2) that identifies an individual as having requested or obtained specific material or materials on a particular subject; 3) that is provided by an individual to assist a Library staff member to answer a specific question or provide information on a particular subject; and 4) which is personal information identifying an individual who has used any Library service or borrowed any Library materials, except the information in the following circumstances may be disclosed: 1. If a Library record or patron information pertaining to a minor child is requested from the Library by the minor child's parent, guardian or custodian; 2. Pursuant to and in accordance with: a. a subpoena, search warrant or other court order; or b. to a law enforcement officer acting in the scope of the officer's law enforcement duties investigating a matter involving public safety and exigent circumstances. 3. Upon the consent of the individual who is the subject of the Library record or patron information; 4. For administrative Library purposes, including the establishment or maintenance of a system to manage the Library records or to assist in the transfer of Library records from one records management system to another, compilation of statistical data on Library use and collection of fines and penalties; and 5. Pursuant to Ohio Revised Code Section 149.43(B) regarding records that document improper use of the Internet at the Library so long as any patron information is removed from those records. The Director of the Library shall take steps as deemed appropriate by the Director to advise all librarians and other Library employees of this policy and the Director is authorized and directed to implement procedures in furtherance of this policy.
